Terms and Conditions

These are the terms and conditions (the "Terms and Conditions") that govern the relationship between you, the participant ("you", "your(s)") and PXG UK Limited, C/O Fieldfisher Riverbank House, 2 Swan Lane, United Kingdom (the "Promoter", "we", "our", "us") in relation to the PXG Black Ops Driver Challenge (the "Promotion").

ELIGIBILITY

  1. The Promotion is only open to residents in the United Kingdom who are aged eighteen (18) years old at the time of participation.
  2. The following are not eligible to participate in this Promotion: (i) employees of the Promoter, its respective subsidiaries and associated companies, its advertising and promotional agencies or the prize suppliers, and each of their respective direct and indirect subsidiaries and affiliates, and each of their respective shareholders, partners, members, officers, directors, agents, representatives and employees (collectively, the "Promotion Entities"); (ii) immediate family members of such employees or of anyone with whom such employees are domiciled. In these Terms and Conditions, "immediate family" includes mother, father, brothers, sisters, sons, daughters, partner or spouse.
  3. The Promoter assumes that by participating in the Promotion you have legal capacity to enter the Promotion and agree to the Terms and Conditions (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract).

PROMOTION PERIOD

  1. The Promotion will run from 12:00 A.M. (BST) on March 16th, 2024 to 11:59 P.M (BST) on April 30th, 2024 (the "Promotion Period").

HOW TO PARTICIPATE

  1. In order to participate in the Promotion:
  2. Schedule a fitting for a new PXG Black Ops Driver with a PXG Master Fitter to take place during the Promotion Period by calling [0800-066-9449] or booking online at www.pxg.com
  3. Bring your current driver (which must not be a PXG Black Ops Driver) to the fitting. 
  4. During your fitting, we will evaluate your performance using your current driver and then compare it to your performance using our fitter-optimized Black Ops Driver. Using Trackman technology we will record five (5) shots using each driver and then compare your best three (3) shots for each driver ("Best Shots") provided that your swing speed for each of the shots using the Black Ops Driver is within 3mph (4.83 kph) of your swing speed using your current driver. You must use the same dexterity, including but not limited to identical hand positioning, with both your current driver and the Black Ops Driver. To maintain the integrity of this Promotion and in PXG’s sole discretion, significant changes in any of the following swing characteristics including club head speed, attack angle, or swing path is not permitted. PXG Master Fitters retain the right to choose from the complete shaft matrix offered by Promoter. The data will be shared with you during your fitting.
  5. We are confident that in nearly every case, with a similar swing speed, our Black Ops Driver will deliver more distance or tighter dispersion than your current set-up. If we are right, you have no further obligation, but we know that once you swing PXG Black Ops, you are going to want it.
  6. If during your PXG fitting your Best Shot using the Black Ops Driver does not deliver more distance or tighter dispersion than your Best Shot using your current driver, we will send you a Rewards Card (as described below).
  7. If you do not complete the fitting and accept these Terms and Conditions, you will not be eligible to receive the Rewards Card.
  8. The Promotion is limited to one (1) participation per person and any attempt by you to participate by booking multiple fittings and/or any other methods will void your participation and you may be disqualified from the Promotion. Entry to this Promotion does not preclude you from entering other promotions offered by the Promoter.

Rewards Card

  1. The Rewards Card is an Amazon Rewards Card with a value of £200 (the "Rewards Card"), subject to availability and with an expiration date of one (1) year from [date of reward].
  2. Use of the Rewards Card shall be subject to the Rewards Card provider's terms and conditions.
  3. The Rewards Card must be accepted as awarded and is non-transferable or convertible to other substitutes.
  4. If due to circumstances beyond our control we are unable to provide the stated Rewards Card, we reserve the right to award a substitute gift of equal or greater value.
  5. Following successful claim of a Rewards Card during the fitting, we will arrange for electronic delivery of the Gift via email to you. We will endeavour to deliver the Gift within [14 days] of your fitting.

GENERAL

  1. By participating in the Promotion, you agree to be bound by:
  2. these Terms and Conditions (which may be amended or varied at any time by us with or without notice); and
  3. by our decisions, which are final in all matters relating to these Terms and Conditions, and the Promotion and no correspondence or discussion shall be entered into.
  4. All changes to the Terms and Conditions will be posted in revised terms and conditions.
  5. We accept no responsibility for any incorrect or inaccurate information and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, line failure, theft or destruction or unauthorised access to entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control (to the fullest extent permitted by law).
  6. We reserve the right, in our sole discretion, to cancel, terminate, modify, extend or suspend this Promotion for any reason, in particular if the secure, fair and proper conduct of the Promotion is affected. Other restrictions may apply.
  7. Personal information collected from you will be used by us solely in connection with the Promotion and will not be disclosed to any third party except for the purpose of operating the Promotion and awarding Rewards Cards where applicable. 
  8. We and our agents acknowledge that as a data controller we are required to comply with applicable obligations under relevant data protection and privacy laws. For the purposes of this Promotion, your personal information may be stored and processed on servers overseas. You explicitly consent to the transfer of your data collected in connection with the participation in the Promotion to countries outside the European Economic Area, including the US. You acknowledge that these countries may not provide for the same level of data protection as applicable in the EU. However, wherever we or our agents process your information we will use our reasonable endeavours to ensure that it is protected at all times in accordance with strict data protection standards. Personal data will be kept confidential and will not be made accessible to third parties other than for the purpose of this Promotion.

  10. These Terms and Conditions shall be governed by and construed in accordance with English law and any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English Courts.
